Another Social Worker Drags Federal Government to Court Over the Anti-Gay Law!

A Federal High Court sitting in Abuja has given the Federal Government till April 28, 2014 to react to a suit challenging the recent law which criminalized Same S*x Marriage in Nigeria. Justice Abdu Kafarati yesterday said that he would commence hearing in the case on the next adjournment date. One Teriah Joseph Ebah had through his counsel, Mike Enahoro Ebah, dragged the federal government to court.
He is claiming that the Act of the National Assembly as endorsed by President, Goodluck Jonathan violates the provisions of the 1999 constitution and the African Charter on Human and Peoples Rights.
The United Nations had recently made similar comment on the issue.
Ebah is therefore urging the court to stop the Federal Government from implementing the Same S*x Marriage Prohibition Act.

In his originating summons, he is praying the court for a declaration that the provisions of Same S*x Marriage (Prohibition) Act, 2013 particularly sections 1(1) (a), (b), (2), 2(1) &(2) and 3 violates and contravenes Nigeria Citizens Fundamental Rights as enshrined and protected in Section 42 (1)(a) (b) of the Constitution of the Federal Republic of Nigeria, 1999 and Articles 2,3 (1) and (2), 19 and 29 of the African Charter on Human and Peoples Right (Ratification and Enforcement) Act, Cap A9, Laws of the Federation of Nigeria, 2004, and is accordingly unconstitutional, null and void.
